Credit Information Consent and Terms of Use

By selecting "I Agree", "Authorize", "Show My Credit Score", or any similar option on the Platform, I voluntarily provide my free, specific, informed, unconditional, and unambiguous consent to SMC Insurance Brokers Pvt. Ltd. ("SMC Insurance") to collect, process, access, and obtain my Credit Information Report, Credit Score, income estimation (where available), and other credit-related information from CRIF High Mark Credit Information Services Private Limited ("CRIF High Mark") or any other Credit Information Company ("CIC") authorized under applicable law.

Purpose of Processing

I understand that my credit information shall be obtained and processed solely for the following purposes:

• evaluating my eligibility for insurance and related financial products or services requested by me;
• facilitating insurance product recommendations, premium assessment (where applicable), underwriting support, fraud prevention, risk assessment, and regulatory compliance;
• identity verification and customer due diligence (where permitted under applicable law); and
• any other lawful purpose directly connected with the products or services requested by me.

My credit information shall not be used for any purpose that is incompatible with the purposes stated above, unless otherwise permitted under applicable law or with my consent where required.

Authorization

I authorize SMC Insurance to act on my behalf solely for the purpose of obtaining my credit information from CRIF High Mark or any other authorized Credit Information Company and to share such information only with insurers, financial institutions, service providers, regulators, or other authorized entities, strictly on a need-to-know basis and only to the extent necessary for the purposes stated above.

Validity of Consent

This consent shall remain valid until the earliest of:

• completion of the purpose for which the credit information was collected;
• withdrawal of my consent, where withdrawal is legally permissible;
• expiry of the retention period prescribed under applicable law or regulatory requirements; or
• any other period required under applicable contractual or regulatory obligations.

Withdrawal of consent shall not affect any processing already undertaken prior to such withdrawal or any processing required to comply with applicable law.

Processing and Protection of Personal Data

I acknowledge that my personal data and credit information shall be processed in accordance with the Digital Personal Data Protection Act, 2023, the Credit Information Companies (Regulation) Act, 2005, applicable rules, IRDAI regulations, and the Privacy Policy of SMC Insurance.

SMC Insurance shall implement reasonable technical and organizational safeguards to protect my personal data and shall process it only for lawful purposes.

Accuracy of Information

I understand that my Credit Information Report and Credit Score are generated and maintained by the respective Credit Information Company based on information received from financial institutions and other authorized sources. SMC Insurance does not modify, validate, or guarantee the accuracy, completeness, or timeliness of such information.

Electronic Consent

I acknowledge that selecting "I Agree", "Authorize", "Proceed", "Show My Credit Score", or any similar electronic acceptance mechanism shall constitute my valid electronic consent and authorization for SMC Insurance to obtain my credit information for the purposes described above. Such electronic consent shall have the same legal effect as a written consent, to the extent permitted under applicable law.

Limitation of Responsibility

I acknowledge that SMC Insurance acts as an insurance broker and facilitator for obtaining my credit information. The respective Credit Information Company remains responsible for maintaining and providing credit information in accordance with applicable law. Nothing contained in these Terms limits or excludes any rights or remedies available to me under applicable law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the jurisdiction specified in the applicable Terms of Use of SMC Insurance, unless otherwise required under applicable law.

By clicking "I Agree", "Authorize", "Proceed", or "Show My Credit Score", I confirm that I have read, understood, and voluntarily consent to the collection, use, processing, sharing, and retention of my personal data and credit information for the purposes described above. I also confirm that I have read the Privacy Policy, Terms of Use, and the applicable Credit Information Company's Terms of Use.
