SMC Insurance expects its business partners, vendors, service providers, consultants, and other third parties to conduct their business with us in accordance with the SMC Insurance's applicable Intellectual Property protection policies, contractual obligations, and all relevant laws.

Prior to entering into any business relationship, SMC Insurance may undertake appropriate due diligence and risk assessments of prospective business partners. Such assessments may include an evaluation of the prospective partner's Intellectual Property governance, protection measures, ownership practices, compliance framework, and ability to safeguard our Intellectual Property and confidential information throughout the course of the engagement.

Security and Confidentiality

SMC Insurance maintains appropriate physical, technical, and administrative safeguards to protect confidential information, proprietary data, and Intellectual Property assets. Confidential information shall only be shared on a need-to-know basis and, where necessary, under Non-Disclosure Agreements (NDAs) or other confidentiality arrangements. Any Intellectual Property created by employees, consultants, or contractors during the course of their engagement with SMC Insurance, relating to our business, shall remain the property of SMC Insurance unless otherwise agreed in writing.

Training and Awareness

SMC Insurance shall conduct periodic training and awareness programs to promote compliance with Intellectual Property laws, obligations, copyright protection, trademark usage, and information security practices. SMC Insurance may license, assign, transfer, or permit the use of its Intellectual Property assets through legally valid agreements that clearly define ownership, usage rights, restrictions, and obligations. SMC Insurance may transfer its Intellectual Property to any of its Subsidiaries, Affiliates or a third party (ies) through a signed Intellectual Property transfer agreement on the conditions as may be deemed to be fit and proper with SMC Insurance.

Intellectual Property Compliance Team

SMC Insurance's Intellectual Property protection and management shall be implemented through a cross-functional compliance team, overseen by a Director or CFO of SMC Insurance or designated senior management. The said compliance team may appoint or engage any advocate or expert from within and/or outside of SMC Insurance to seek their opinion in carrying out their responsibilities as stated under this Intellectual Property Policy.

Scope and Quality of Risk Assessment

SMC Insurance shall include in its risk assessment of new products, services, and business opportunities, any relevant IP protection risks.

Jurisdiction

Eligibility

Further to this, SMC Insurance reserves its right, without assigning any reason, to restrict or limit your access to platform and can further terminate your access to platform and deny the services available through or at SMC Insurance Platform. This right of suspension / termination of services of GSMC, is in addition to any other remedy available to SMC Insurance, for access & usage of platform or availing any of SMC Insurance services through platform, which is in contravention of any of the terms and conditions of Terms of Use or this Agreement or any other applicable law.

By accessing, browsing and using this platform or availing services, you agree and acknowledge that, you understand this limited and restricted use. It's important to note that SMC Insurance does not engage in cash transactions for any business dealings.

SMC Insurance reserves its right to modify, suspend, cancel or discontinue any or all sections, or services at any time without any notice. You agree that SMC Insurance shall not be liable to you or to any third party for any modification, suspension or discontinuance of the platform.

All information and material available on the platform are only to assist the user who are interested in the services provided by SMC Insurance and who wants to explore more options before concluding their transactions.

Any user, who avails of the services after visiting platform, does so solely at his own discretion, risk and responsibility. SMC Insurance does not make any recommendations nor gives any warranty (implied or express), guarantee or otherwise with respect to the quality, functionality, fitness for a particular purpose.

While we strive to maintain the highest standards of accuracy, there may be instances where data errors or inaccuracies could occur. The customer, or user, or partner acknowledges and agrees that they shall not make SMC Insurance liable for any such errors. In the event that any inaccuracy or discrepancy is identified, the customer, or user, or partner is obligated to promptly notify SMC Insurance to facilitate resolution.

You acknowledge and agree that details available on platform are available for information purposes.

When you avail of any of the services after visiting the platform, you shall alone be responsible to complete the documentation part as per applicable laws and SMC Insurance shall not be responsible for any consequences (including without limitation, cancellation of transaction, incomplete or improper documentation) whatsoever.

You hereby grant unconditional and unequivocal consent and authorize SMC Insurance while acting on your behalf for facilitating the transaction on platform, to make use of your vehicle registration number or any other vehicle details as submitted by you on the platform, to retrieve the information about your motor vehicle or to confirm/ verify respective vehicle details from government or third party websites and applications through the use of technological solutions or any other method itself or through third party service providers.

If you require certain additional services, SMC Insurance is not and shall not be obliged to provide any such additional services.

SMC Insurance strongly advises you not to test the platform with false purchases request, as it may put you at substantial personal legal risk. It is a crime to use a false name or other false personal information to buy policy will fully entering erroneous or fictitious purchase requests may result in prosecution by SMC Insurance and/or the seller. Please be aware that even if you do not give SMC Insurance, your real name, your web browser transmits a unique address to us, which can be used by law enforcement officials to identify you.

Your Account and Login Options

Users may access the platform or other information and material as available on the platform, as a guest user, without any requirement of registration. Certain features and information are made available on the platform for all users (called ‘Guest User’) who do not need to register or create an account on the platform. However, to avail other certain features, need to register/ create an account by providing certain details e.g. name, contact details, email id, etc. (“Your Information”).

Once you register on platform by providing Your Information through OTP authentication using your mobile number, SMC Insurance sets up an account (“Your Account”) that is unique to you, subject to your compliance adherence with account creation guidelines and any other applicable law, or rule. SMC Insurance recognizes you as a registered user (Registered User) and you can login into Your Account and avail the services.

If you use or access our platform or avail any services through or at platform as a Registered User, you acknowledge and agree that you shall be solely responsible for maintaining the confidentiality and shall not disclose the details of Your Account to any other person and that any activity occurred under Your Account shall be Your responsibility.

You agree that when you provide Your Information while registering/ creating Your Account with Us, You shall not provide any information which is untrue, false, inaccurate, incomplete, or not current and shall not use the details of any other person, or another user’s account. SMC Insurance may suspend/ delete Your Account or can limit/ deny the access to the platform or services, at any time, if Your Information is found to be untrue, false, inaccurate, not current, or pertains to another user’s account.

You agree that collection, storage, sharing, or disclosure of Your Information that you provide to us either as a guest user or Registered User or otherwise shall be governed by the Privacy Policy of SMC Insurance, incorporated herein by way of reference.

You expressly understand and agree that to the maximum extent permitted by applicable law SMC Insurance will not be liable for any loss that you may incur as a consequence of unauthorized use of your Account or Account information in connection with the Platform or any Services, either with or without your knowledge.

User Content

Being the originator of any information or material made available by you through the platform (”User Content”), you are solely responsible for the User Content that you upload, post, publish, transmit or otherwise make available on the platform. Though SMC Insurance does not pre-screen the User Content, shall have the right with SMC Insurance (but not the obligation) in their sole discretion to accept, refuse, move, or remove any User Contents that are available via platform.

You are prohibited to access or copy any Content or User Content on platform, including any derivatives thereof, through manual and/or automated means, such as page scraping, data mining, data gathering, indexing, using software, devices, bots, crawlers, spiders, scripts, deep links, browser plug-ins, or by breaching, disregarding, or violating any limitations or instructions in the robot.txt file, if any, embedded in platform or URLs.

In case the User Content is in violates/infringes any patent, trademark, trade secret, copyright, or any other proprietary or privacy rights of any third party or in contravention of any applicable law, then SMC Insurance at its sole discretion may remove or disable the access to the User Content or any part thereof, without any notice to User.

Assignment of User Content: You hereby grant SMC Insurance a perpetual, non-revocable, worldwide, royalty-free, and sub-licensable right and license to use, copy, distribute, display, publish, transmit, make available, reproduce, modify, adapt the User Content and create derivate works of the User Content. You represent and warrant that all of the rights to the User Content that you post or that you otherwise provide on or through the platform; and that, as at the date that the User Content is posted or submitted on the platform: (i) the User Content is accurate; (ii) use of the User Content does not breach these Terms of Use; and (iii) that such User Content is lawful.

When you share any feedback or post any comment (including User Content) on the platform, it is deemed non-confidential. SMC Insurance is at liberty to use any such feedback or User Content and you represent that: (i) Your feedback does not contain confidential or proprietary information of you or third parties; (ii) SMC Insurance is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) SMC Insurance may have something similar to the feedback already under consideration or in development, and (iv) You are not entitled to any compensation or reimbursement of any kind from SMC Insurance for the feedback under any circumstances.

By providing your personal data and documents to SMC Insurance Brokers Pvt Ltd  ("the SMC Insurance") for processing and analysis related to insurance activities, you acknowledge and agree to the following terms:

  • Consent to Data Collection: You have explicitly consented to SMC Insurance collecting, processing, and storing your personal data in accordance with the Digital Personal Data Protection Act, 2023.

  • Purpose of Data Use: The information and documents you provide will be utilized for the sole purpose of managing insurance-related needs and preferences.

  • Data Retention: Your personal data and documents will be retained by SMC Insurance to facilitate ongoing services and communications regarding your insurance preferences and requirements.

Audit and Information Sharing

SMC at all times reserves its right, but not an obligation, to audit the Content, User Content, features available on platform, or any other material or information posted/uploaded by the User. If at any time, in the sole discretion of SMC Insurance, determines that any Content/User Content or any other material or feature of platform is in contravention of any law for the time being in force or spirit of the terms and conditions of this Agreement or violates the privacy of any person, then SMC Insurance may either remove or edit or block such material without any notice.

Further to this, it is informed that SMC Insurance may share the information about such instance (with or without demand) with a government agency for the purpose of verification of the identity of User, or for prevention, detection, investigation, prosecution, and punishment. Therefore it is advised to you that you should not involve in any such activities or use which violate any applicable law, rules, regulation or breach the terms and conditions of this Agreement.

“Contents" or "Content" shall mean any and all information, data, text, photographs, graphics, video, messages, materials, forms, documents, magazines, promotional emails, carousel, or other materials and information which may be viewed or downloaded on or through this Platform.

Feature" or "Features" may include any interactive, value addition service or other additional feature which are introduced or available on platform.

You agree that collection, storage, sharing, or disclosure of your information that you provide to us either as a guest user or registered user or otherwise can be shared with group and associate companies of SMC Group as necessary for the purposes outlined in our privacy policy.

Third Party service Providers

SMC Insurance uses third-party service providers to assist SMC Insurance in improving our services and platform and to monitor our Users’ interests and activities. You hereby authorize SMC Insurance and/or third party service providers engaged by SMC Insurance to collect, use, store, analyze, reproduce, publish, and adapt (either on its own or through a third party service provider) the information in relation to your use of platform for the purpose of data analysis and for improving your experience on platform. You acknowledge that this is solely undertaken by SMC Insurance to improve your experience in relation to the use of the platform and the provision of such services shall be subject to such additional terms and conditions of SMC Insurance and/or third party service providers.

Payment Related Information

Access to platform is free and Users (Registered or Guest) can browse the information/ products and avail the services free of charge. Please note that SMC Insurance is only assisting in the collection of premium amount on behalf of the insurer, whose insurance product you have chosen to buy. The acceptance of the insurance premium and final issuance of the policy is subject to underwriting norms and discretion of respective insurance company, whose policy you have chosen to buy.

License and Platform Access

Subject to the compliance with all applicable laws, rules and terms and conditions of this Agreement and/or Additional Terms. SMC Insurance grants the User a limited, non-exclusive, non-sub licensable, non-transferable, revocable, and limited permission to access and use the platform and avail the services provided through or at the platform, subject to the following conditions:

The license shall not include: (i) any resale or commercial use of this platform or its contents; or (ii) any derivative use of this platform or its contents;

You, your partners, your employees, your agents, or any other person associated with you personally or professionally, may not, with or without compensation, prepare any derivative works from, or sell, lease, license, e-mail, reproduce, duplicate, copy, resell, republish, transmit or distribute or otherwise exploit for any commercial purpose via any media, now known or unknown, any contents from this platform to any other entity or individual.

No Contents or information on platform may be reproduced in any form or incorporated into any internet website or any other information retrieval system, either electronic or mechanical. It is a condition of your use of this platform that you do not restrict or inhibit any other user from using this platform.

You shall not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of SMC Insurance without the express written consent of SMC Insurance.

Any software that is available on platform is the property of SMC Insurance or its vendors. You may not use, download or install any software available at platform, unless otherwise expressly permitted by the Agreement or by the express written permission of SMC Insurance.

Any unauthorized use terminates the permission and the license granted by SMC Insurance under this Agreement to you.

Modification: All information available on platform is made available to you on best efforts basis, however, SMC Insurance does not guarantee nor assume any responsibility for the correctness of such information/data. SMC Insurance reserves the right to modify, suspend/cancel, or discontinue any or all sections, or services at any time without notice. In case the information (including without limitation pricing, description, and any other information, etc.) is found to be not up to date or incorrect, SMC Insurance reserves the right to make modifications and alterations in the information contained on platform without notice. You agree that SMC Insurance shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Platform.

Intellectual Property Right

Platform itself and all content and other works on the platform are the copyrighted works of SMC Insurance or its licensors. Any alteration of platform or alteration of the material or use of the material contained in the platform for any commercial purpose is a violation of the copyright of SMC Insurance.

Platform may also contain certain trade-marks, logos, or service marks (“Marks”). These marks are proprietary to SMC Insurance or third parties. You are not permitted to use the marks, in any manner, without first obtaining the written permission of the SMC or third party that owns and controls the Marks.

YOU ACKNOWLEDGE AND AGREE THAT THROUGH YOUR USE OF PLATFORM OR BY AVAILING ANY PRODUCT OR SERVICES THROUGH OR AT PLATFORM, NO RIGHT (EMPRESS OR IMPLIED) IS GRANTED TO YOU IN RESPECT OF SUCH CONTENT. SMC INSURANCE RESERVES THE RIGHT TO CHANGE OR MODIFY THE CONTENT FROM TIME TO TIME AT ITS SOLE DISCRETION.

You further acknowledge and agree that you shall not copy, reproduce, republish, upload, post, transmit or distribute, available content on the platform, in any way without obtaining prior permission from SMC Insurance or its licensors. All responsibility and liability for any damages caused by downloading of any data are disclaimed.

It is clarified that any use of the platform, content, marks, or other intellectual property rights of SMC, in contravention of the terms of this Agreement or any applicable law shall constitute the infringement of such intellectual property right of SMC Insurance or their third party, upon which SMC Insurance or third party may initiate the appropriate legal proceedings against the User.

Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, SMC Insurance owns all intellectual property rights to and into the platforms, including, without limitation, any and all rights, title, and interest in and to copyright, related rights, patents, utility models, designs, know-how, trade secrets and inventions (patent pending), goodwill, source code, meta tags, internal linking, databases, text, content, graphics, magazines, promotional emails, icons, and hyperlinks.

ALL RIGHTS NOT EXPRESSLY GRANTED HEREUNDER TO THE USER, ARE RESERVED EXCLUSIVELY FOR SMC INSURANCE.

Indemnification

You agree to indemnify, defend and hold harmless SMC Insurance and its respective directors, officers, employees, and contractors (hereinafter individually and collectively referred to as "Indemnified Parties") from and against any and all losses, liabilities, claims, suits, proceedings, penalties, interests, damages, demands, costs and expenses (including legal and other statutory fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by the Indemnified Parties that arise out of, result from, or in connection with (i) Your breach of the Agreement(s); or (ii) any claims made by any third party due to, or arising out of, or in connection with, your use of the platform; or (iii) any claim that any User Content, information or materials provided by You caused damage to a third party; or (iv) Your violation of any rights of another, including any intellectual property rights.
SMC Insurance may notify of any claims which you shall be liable to indemnify SMC Insurance against. You will then be required to consult with SMC Insurance regarding the course of action to be undertaken in defending such a claim. Further, you shall not compromise or settle any claim or admit any liability or wrong doing on the part of SMC Insurance without the express prior written consent of SMC Insurance which can be withheld or denied or conditioned by SMC Insurance in its sole discretion.

Disclaimer of Warranty and Liability

All content, or information pertaining platform or any product/ services are provided to you on

“As Is” basis and without warranty of any kind, express, implied, statutory or otherwise, including.

The implied warranties of title, non-infringement, merchantability or fitness for a particular purpose.

When you access the platform or avail any product or services at or through platform, you do so at your own risk. You understand that there may be delays, omissions, interruptions, inaccuracies, and/ or other problems with the information, and services published on or promoted through this platform. Without limiting the foregoing, SMC Insurance makes no warranty that:

Platform or Services will meet your requirements or your use of platform or the services will be uninterrupted, timely, secure, or error-free;

The results that may be obtained from the use of platform or services will be effective, accurate, or reliable.

The Quality of platform or services will meet your expectations; or any errors or defects in platform or services will be corrected. No advice or information, whether oral or written, obtained by you from SMC Insurance or through platform/ content or from Use Of Services shall create any warranty not expressly stated in these terms of use.

Platform will be or continuously available, or this platform will be free of viruses or other harmful components and other codes that contain contaminating or destructive properties.

To the fullest extent permissible pursuant to the applicable law, SMC Insurance disclaims all warranties, express or implied related to platform, content, user content, services, arising under intellectual property right, libel, privacy publicity, obscenity or other laws. SMC Insurance also disclaims all liability with respect to misuse, loss, modification, or unavailability of any user content.

Not with standing anything to contrary in the Agreement(S), in no event shall SMC Insurance and its respective Officers, Directors, Employees, be liable to you for any special, incidental, indirect, consequential, exemplary or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not SMC Insurance has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of or access to platform, services, content, user content.

You further acknowledge and agree that if you purchase/ download platform from other third party service providers (e.g. Google Play store, Apple store etc.), then neither SMC Insurance nor any third party service provider shall be held liable for error or failure on the part of platform to function properly. You shall follow rules/ guidelines before downloading/ installing platform as recommended by third party service providers.

SMC Insurance entire and aggregate liability to you under and in relation to these terms of use or otherwise shall not exceed the greater of Indian Rupees One Hundred (INR 100) or amount of fees, if any, paid by you to SMC Insurance under the relevant order to which the cause of action for the liability relates.

Governing Law and Jurisdiction

This Agreement or the documents incorporated herein by reference shall be governed and construed in accordance with the laws of India. All disputes arising under this Agreement between you and SMC Insurance shall be subject to the exclusive jurisdiction of courts in Delhi, India.

Force Majeure

SMC Insurance shall not be liable for any failure and/or delay on its part in performing any of its obligations under this Agreement and/or for any loss, damage, costs, charges, and expenses incurred and/or suffered by the User by reason thereof if such failure and/or delay shall be the result of or arising out of Force Majeure Event set out herein.

"Force Majeure Event" means any event due to any cause beyond the reasonable control of SMC Insurance, including, without limitation, unavailability of any communication system, sabotage, fire, flood, earthquake, explosion, acts of God, civil commotion, pandemic, strikes, lockout, and/or industrial action of any kind, breakdown of transportation facilities, riots, insurrection, hostilities whether war be declared or not, acts of government, governmental orders or restrictions, breakdown and/or hacking of platform and/or contents provided and/or services under platform, such that it is impossible to perform the obligations under the Agreement, or any other cause or circumstances beyond the control of SMC Insurance hereto which prevents timely fulfilment of the obligation of SMC Insurance.

Miscellaneous

Severability: If any clause of this Agreement shall be deemed invalid, void, or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the Agreement.

Waiver: Any failure or delay by a party to enforce or exercise any provision of the Agreement, or any related right, shall not constitute a waiver by such party of that provision or right. The exercise of one or more of a party's rights hereunder shall not be a waiver off or preclude the exercise of, any rights or remedies available to such party under these Terms of Use or in law or at equity. Any waiver by a party shall only be made in writing and executed by a duly authorized officer of such party.

Contacting You: By accessing our Platform and/or availing any service or product at or through our platform, you give your consent to us and both our associate partners (including dealers, financial institutions, etc.) to communicate with you through phone calls/SMS/email communication, etc. regardless whether your number is registered in National Do Not Call Registry (NDNC).

Customer Due Diligence (CDD) and Know Your Customer (KYC)

To facilitate the purchase, servicing, or renewal of insurance products through the Platform, SMC Insurance may be required to conduct Customer Due Diligence (CDD), Know Your Customer (KYC) verification, identity verification, and other checks as mandated under applicable laws, regulations, and regulatory guidelines, including the Prevention of Money Laundering Act, 2002 (PMLA) and related rules.

By using the Platform, you agree to provide accurate, complete, and up-to-date information and documents as may be required for identity verification, KYC, CDD, fraud prevention, regulatory compliance, or any other lawful purpose. You acknowledge that failure to provide the requested information or documentation may result in the inability to process your request or provide the requested products or services.

Where permitted under applicable law and with your consent where required, you authorize SMC Insurance to obtain or verify information, including credit-related information or identity information, through authorized agencies, service providers, insurers, or government-authorized verification systems for the purpose of fulfilling regulatory and contractual obligations.

You further agree that insurance premium payments should ordinarily be made from a bank account held in your name or a joint bank account in which you are an account holder. If a premium payment is received from a third-party bank account, SMC Insurance and/or the relevant insurer may carry out additional due diligence and request further information or supporting documentation before processing the transaction.

You acknowledge that refunds, where applicable, shall be processed by the concerned insurer in accordance with applicable laws, regulatory requirements, and the insurer's policies. Refunds may be credited to the original source account used for payment of the insurance premium or through such other mechanism as permitted under applicable law and the insurer's procedures.

Cancellation, Refunds and Chargebacks

1. Free Look Cancellation and Refund
For eligible insurance products, you may have the right to cancel your policy during the applicable Free Look Period as prescribed by the Insurance Regulatory and Development Authority of India (IRDAI) or any other applicable law. The availability, duration, eligibility, and conditions of the Free Look Period are determined solely by the concerned insurer and the applicable regulatory framework.

If you submit a valid cancellation request within the applicable Free Look Period, the insurer will process your request in accordance with its underwriting guidelines, policy terms, and applicable laws. Any refund of premium shall be made by the insurer after deducting such amounts, if any, as permitted under applicable regulations, including but not limited to charges towards medical examinations, stamp duty, applicable taxes, mortality charges for the period the risk was covered, or any other deductions permitted by law.

SMC Insurance acts solely as an insurance intermediary and does not determine the eligibility, approval, amount, or timeline of any refund. All refund decisions and payments shall be made by the concerned insurer in accordance with applicable laws, regulatory requirements, and the insurer's internal policies.

Users are advised to carefully review the policy document immediately upon receipt and exercise the Free Look option, where applicable, if the policy terms do not meet their insurance requirements.

2. Chargebacks
If you believe that a payment transaction made through the platform is unauthorized, erroneous, or otherwise qualifies for a chargeback under the applicable rules of your payment instrument issuer, card network, Reserve Bank of India (RBI), or applicable law, you may initiate a chargeback request with your issuing bank or payment service provider.

You acknowledge that insurance premium payments are generally forwarded to the respective insurer for policy issuance and servicing. Accordingly, where a policy issuance, underwriting, medical examination, premium allocation, or any other insurer-controlled process has already commenced or has been completed, the chargeback request may be subject to review and may not be accepted in accordance with applicable banking rules, payment network regulations, and the insurer's policies.

SMC Insurance reserves the right to contest or respond to any chargeback request by providing supporting transaction records or other relevant information to the acquiring bank, payment gateway, issuing bank, insurer, or other authorized entities, where appropriate.

SMC Insurance shall not be responsible for any delay, rejection, or dispute relating to policy issuance, underwriting, medical examinations, refunds, or chargeback decisions that are determined by the insurer, payment service provider, issuing bank, card network, or any regulatory authority. Any disputes relating to insurance policy issuance, cancellation, refund, or claims shall be governed by the terms of the applicable insurance policy and the relevant insurer's policies, subject to applicable law.

Additional Terms for Health Insurance Proposal Forms

The following terms apply where you submit an application for a health insurance product through the Platform:

  1. Accuracy of Information: You confirm that all information, declarations, and documents provided by you, whether for yourself or on behalf of any person proposed to be insured, are true, complete, accurate, and provided in good faith. Where you submit information on behalf of another individual, you confirm that you are duly authorized to do so.
  2. Basis of Underwriting: You acknowledge that the information provided in the proposal form will be relied upon by the insurer for underwriting and risk assessment. The issuance of an insurance policy is subject to the insurer's underwriting guidelines, acceptance of risk, receipt of the applicable premium, and compliance with applicable laws and regulatory requirements.
  3. Duty to Update Information: You agree to promptly inform the insurer, through the platform or any other prescribed mode, of any material change in the health condition, occupation, or any other information relevant to the insurance proposal that occurs after submission of the proposal and before the insurer communicates its decision regarding acceptance of the risk.
  4. Medical and Verification Consent: To the extent permitted under applicable law and with your consent where required, you authorize the insurer to obtain, verify, or receive relevant medical, health, or underwriting information from hospitals, medical practitioners, diagnostic centres, previous insurers, employers, or other authorized sources solely for the purposes of policy underwriting, policy servicing, fraud prevention, regulatory compliance, claim assessment, or claim settlement.
  5. Sharing of Information: You acknowledge and consent that your proposal details and related personal data, including health information where necessary and permitted by law, may be shared by SMC Insurance with the concerned insurer, its authorized service providers, reinsurers, third-party administrators (TPAs), government authorities, regulators, or other entities authorized under applicable law, strictly for purposes connected with policy issuance, servicing, claims processing, fraud prevention, regulatory compliance, or any other lawful purpose.
  6. Authorized Representatives: You consent to the insurer and its duly authorized representatives, agents, service providers, or partners (who may not be direct employees of the insurer), contacting hospitals, medical practitioners, or healthcare providers to obtain information reasonably required for underwriting, policy administration, or claim processing, subject to applicable laws and appropriate confidentiality obligations.

a) Issuance and Crediting of the Policy Document / Certificate of Insurance / Proposal Form

Turnaround time is 15 calendar days from the date of receipt of complete documents.

Medical checkups are required by the Insurers per the plan that the customer has procured. If the plan requires a medical check up - once customer has made the payment of the recently purchased online plan, he/she would be routed to complete the next steps i.e. Schedule Medical (if applicable).

c) Issuance of Endorsement

An endorsement is issued to the policyholder whenever any contractual changes (permitted by the plan/policy) are requested by the policyholder, accepted by the Insurer and made in the policy. Please refer to sections (d), (g), (l) and (n) of this document for types of changes and their respective documentation.

The turnaround time is 15 business days from the date of receipt of complete documents.

d) Change of Policy Terms and Conditions/Details Change

Correction of Date of Birth (DOB): Change of DOB request means a change or correction in the Date of Birth of the policyholder, life insured or nominee/trustee.

Documents required:

  • Date of Birth Proof
  • Additional Premium (wherever applicable due to change of DOB)

E-Quote Generation on the Digital Platform

The E-Quote for a customer is generated once he/she fills up the basic details like DOB, Gender, Smoker/non smoker, Cover Amount, personal details – Name, mobile, email ID.

Plan Selection & Redirection to Product Page

Upon E-Quote generation customer can check the Quotes from various insurance companies and select any insurance company’s plan that the customer wishes to purchase, he will then be redirected to product page for that insurer which lists down all the details of the plan selected and gives option to select riders.

Redirection to Payment Gateway

Customer is redirected to the payment gateway ( PG) page and premium payment is made by him/her. Customer has various payment options to pay the initial premium at the time of application for example - through internet banking, debit card, credit card and wallets. These options are available on the payment page of the proposal form journey on our website/ mobile application. This might change from time to time. Apart from this, standing instruction option is also available to pay future renewal premiums. Once customer has made the payment online, he/she would be directed to complete the next steps i.e. Fill Proposal form, Upload Documents & Schedule Medical (if applicable).

Filling Up the Proposal Form

Underwriting of insurance proposals is done basis the disclosures by the life insured/proposer in the proposal form, hence it is mandatory to verify the details filled in the proposal form and authenticate them through OTP (One-time password) authentication.

On completion of payment and proposal form filling, a copy of proposal form (PDF) along with payment acknowledgment will be sent to the customer’s registered email ID.

The proposal form journey consists of the following sections:

  • Personal Details —  This section contains details like name, contact details, education, nationality
  • Employment Details —  This section contains details like employment like salaried / self employed, name of employer, designation, income.
  • Address Details — This section contains details like Address, City & Pin Code.
  • Insurance History — This section contains details on any other insurance cover.
  • Nominee Details — This section contains details on nomination like name, relation.
  • Lifestyle & Well-being — This section contains details like height, weight, travel & adventure.
  • Health — This section contains details regarding medical disclosure on any previous investigations, diagnosis or treatment.
  • OTP Authentication — Customer needs to enter the OTP to authenticate the details provided in the proposal form. OTP is sent on customer’s mobile & email with a validity of 30 minutes.

Schedule Medicals

In schedule medical section, the customer needs to select a preferred date and time for medicals. The medicals can either be at customer’s residence or he / she will be required to visit the insurers empanelled diagnostic centres. Policy underwriting & decision of policy issuance is made by the insurer. Once the policy is issued, policy pack will be sent to customer at his / her communication address as selected on the proposal form by the insurer but the soft copy of the issued policy shall be sent to customer’s email ID by SMC Insurance.

Change of Policy Terms and Conditions/Details Change

Fraud Detection Policy

1. Introduction

Company is required to disclose the adequacy of systems in place to safeguard the assets for preventing and detecting fraud and other irregularities. Policy has been formulated considering e-commerce frauds that the Company can be exposed to.

The Policy shall also provide guidance with respect to the prevention, detection, mitigation and investigation into fraudulent activities related to e-commerce.

2. Objective and Policy Statement

The Policy is established to detect, monitor, mitigate and report occurrence of insurance fraud in the Company. It would facilitate development of processes to prevent, detect and manage frauds. Further it will also ensure development of control measures at an organizational level and conducting investigations. The Company is committed to conducting business in an environment of fairness and integrity and will strive to protect itself from any fraud emanating from its operations.

3. Scope and Applicability

This Policy applies to any fraud or suspected fraud involving employees as well as shareholders, consultants, vendors, contractors, outside agencies doing business with the Company and/or any other parties having a business relationship with the Company including insurance advisors/corporate agents of the Company. The policy would also be applicable to policyholders and beneficiaries. Any investigation activity required will be conducted.

4. Review and approval of the policy

The policy will be reviewed and approved by Board of Directors. Risk Management and Fraud Monitoring Department shall assist in the review process and recommend necessary changes in the policy. Policy may be reviewed based on the newly released changes to Acts, regulatory requirements, independent audits and/or internal review.

Procedures

Sr. No. Procedure Description
P-1.1 Board of Directors – The Board is responsible for overseeing the Fraud Control Framework and for approving, reviewing and monitoring compliance with the Policy. The Board may delegate this responsibility to the Risk Management Committee.

First Line of Defence – Primary responsibility for the implementation and practice of fraud risk management, including core risk management principles of risk identification, measurement, management, monitoring & reporting rests with the first line of defence i.e. the concerned process owner / business / line function.

Second Line of Defence – The Compliance and Risk functions are the second line of defence, who are responsible for reviewing and challenging the completeness and accuracy of the first line’s risk identification, measurement, management, monitoring and reporting.

Third Line of Defence – Audit is the third line of defence. Audit is responsible for independent assessment on the effectiveness of the fraud controls framework design and operation, and is also responsible for reporting findings and concerns to the Management and the Company’s Audit and Risk Committees.
P-1.2 Procedures for Fraud Monitoring. The Company will have well defined procedures to identify, detect, investigate and report frauds. The Risk Management and Fraud Monitoring department will develop / manage systems & framework and analytical tool methodologies to identify potential fraud areas / red flags. Through sampling methodology, the team will identify patterns / trends to review processes and will put in place preventive and corrective measures. It also spreads awareness regarding fraud prevention across the Company to develop a culture of zero tolerance to fraud. All incidents and complaints with suspected fraudulent activity are investigated and analyzed. Queries are generated to initiate the investigation and post investigation conclusions, after due validation of evidences, are put up to the Disciplinary Authority for taking appropriate action. All Functional Heads are primarily responsible for day to day management of activities and in charge of maintaining, implementing and improving their systems, processes & controls so that they minimize the possibility of frauds and on a timely basis mitigate the impact of an identified fraud. The Heads of various departments at Corporate Office, and Regional HODs/Directors will submit a report regarding identification and reporting of fraud, if any, in their respective functional / geographical area.
P-1.3 Any employee who suspects or detects dishonest or fraudulent activity should report immediately, in any case, within 48 hours of its detection. While the reporting can be done by any employee / person who suspects / detects the fraud, Head of the Department / Office / Branch is responsible to ensure that the fraud is reported within the aforesaid timelines. Complete information as available should be provided at the time of reporting.
P-1.4 In case the Department / Region / Office have conducted a preliminary investigation of the fraud, the investigation report should be annexed at the time of incident reporting. If there is any doubt as to whether an action constitutes fraud, the Risk Management and Fraud Monitoring Department may be contacted for guidance. Employees and other individuals should not attempt to personally conduct investigations or interviews / interrogations related to any suspected fraudulent act.
P-1.5 Disciplinary action may be initiated against the employee(s) for not reporting or withholding information related to suspected or actual fraud. The Company urges its intermediaries, vendors, policyholders, beneficiaries & all concerned to act in a lawful & proper manner and to report allegations or irregularities in respect of any fraud to the Organization.
P-1.6 The Company ensures that all suspected / actual fraud incidents are investigated, the root cause is determined, appropriate action as per disciplinary matrix is taken, and mitigating controls are implemented to avoid recurrence of such incidents in future.
P-1.7 Risk Management and Fraud Monitoring department shall generate fraud mitigation communication within the Company at periodic intervals or on adhoc basis, as may be required. It must also ensure information flow to concerned departments with respect to frauds.
P-1.8 The Company will inform stakeholders about its Fraud Prevention Policy. The Company will incorporate necessary caution in the insurance contracts / relevant documents duly highlighting the consequences of submitting a false statement and / or incomplete statement, for the benefit of policyholders, claimants and beneficiaries. The Company will proactively identify and monitor frauds on an ongoing basis.
P-1.9 An ongoing awareness program is a key enabler to convey fraud risk management expectations, as well as an effective preventive measure. Awareness of fraud and misconduct schemes should be developed through periodic assessment, training, and frequent communication.
P-1.10 Any exception with respect to the Policy shall be reviewed by the Board. The exception request shall be submitted to the Risk Management and Fraud Monitoring department in the form of a Note addressing the Board with complete description of the said exception.
P-1.11 Fraud events are reported and presented at relevant Committees held periodically. The report details statistics of fraud cases, summary on key cases identified, loss amount, resolution and action etc. Concerned department is responsible for reporting of frauds in the format / template and within the timelines prescribed.

Purchase Order Terms & Conditions

Parties

These terms represent the Agreement that governs the purchase of products and services from the Vendor/ You by the Company / Our / We/ Us.

Applicable Laws and Regulatory Compliance

All the Vendors shall comply with all applicable laws, regulations, guidelines, circulars, and regulatory requirements in connection with the services provided under this Purchase Order. This includes, without limitation, the provisions of the Insurance Act, 1938, the Insurance Regulatory and Development Authority Act, 1999, the Insurance Regulatory and Development Authority of India (Insurance Brokers) Regulations, 2018, as amended or replaced from time to time, and any other applicable laws, rules, regulations, or directions issued by any competent statutory or regulatory authority.

The Vendor shall ensure that its personnel, agents, subcontractors (if permitted), and representatives engaged in providing the services also comply with all such applicable legal and regulatory requirements.

Performance of Services

All the Vendors shall perform the Services with due skill, care, diligence, and professionalism, in accordance with generally accepted industry standards, applicable laws, and the specifications, service levels, and timelines agreed upon between the Parties.

If SMC Insurance identifies any deficiency, defect, non-conformity, or failure in the Services or Deliverables, it shall notify the Vendor, and the Vendor shall, at its own cost and within a reasonable time specified by SMC Insurance, promptly rectify, re-perform, repair, replace, or otherwise remedy such deficiency to the satisfaction of SMC Insurance.

If the Vendor fails to remedy the deficiency within the stipulated time or repeatedly fails to meet the agreed performance standards, SMC Insurance shall have the right, without prejudice to any other rights or remedies available under the Purchase Order, applicable law, or contract, to reject the affected Services or Deliverables, terminate the Purchase Order in whole or in part, recover any resulting losses or damages, and seek any other appropriate legal or equitable remedies.

Confidentiality

All the Vendor acknowledges that, in the course of providing the Services, it may receive or have access to confidential, proprietary, or sensitive information relating to SMC Insurance, its customers, business partners, insurers, employees, systems, operations, products, technology, business plans, financial information, or any other information designated as confidential or which, by its nature, ought reasonably to be treated as confidential ("Confidential Information").

The Vendor shall keep all Confidential Information strictly confidential and shall:

  • use such Confidential Information solely for the purpose of performing its obligations under the Purchase Order;
  • not disclose, publish, copy, reproduce, or make the Confidential Information available to any third party except with the prior written consent of SMC Insurance or where required by applicable law;
  • restrict access to Confidential Information only to its personnel, agents, or permitted subcontractors who have a legitimate need to know such information for the performance of the Services and who are bound by confidentiality obligations no less stringent than those contained herein; and
  • implement appropriate technical, organizational, and administrative safeguards to protect the Confidential Information against unauthorized access, disclosure, alteration, loss, or misuse.

The Vendor shall promptly notify SMC Insurance of any actual or suspected unauthorized access, disclosure, or security incident involving Confidential Information and shall cooperate fully in investigating and mitigating the impact of such incident.

Upon completion, termination, or expiry of the Purchase Order, or upon SMC Insurance's written request, the Vendor shall promptly return or securely destroy all Confidential Information, including all copies, extracts, and records, unless retention is required under applicable law.

The obligations under this clause shall survive the completion, expiry, or termination of the Purchase Order for a period of five (5) years, or for such longer period as may be required under applicable law or agreed between the Parties.

In case the User Content is in violates/infringes any patent, trademark, trade secret, copyright, or any other proprietary or privacy rights of any third party or in contravention of any applicable law, then SMC Insurance at its sole discretion may remove or disable the access to the User Content or any part thereof, without any notice to User.

Assignment of User Content: You hereby grant SMC Insurance a perpetual, non-revocable, worldwide, royalty-free, and sub-licensable right and license to use, copy, distribute, display, publish, transmit, make available, reproduce, modify, adapt the User Content and create derivate works of the User Content. You represent and warrant that you own or otherwise control all of the rights to the User Content that you post or that you otherwise provide on or through the platform; and that, as at the date that the User Content is posted or submitted on the platform: (i) the User Content is accurate; (ii) use of the User Content does not breach these Terms of Use; and (iii) that such User Content is lawful.

When you share any feedback or post any comment (including User Content) on the Platform, it is deemed non-confidential. SMC Insurance is at liberty to use any such feedback or User Content and You represent that: (i) Your feedback does not contain confidential or proprietary information of you or third parties; (ii) SMC Insurance is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) SMC Insurance may have something similar to the feedback already under consideration or in development, and (iv) You are not entitled to any compensation or reimbursement of any kind from SMC Insurance for the feedback under any circumstances.

Data Processing Consent

By providing your personal data and documents to SMC Insurance Brokers Pvt. Ltd. ("the Company") for processing and analysis related to insurance activities, you acknowledge and agree to the following terms:

  • Consent to Data Collection: You have explicitly consented to the Company collecting, processing, and storing your personal data in accordance with the Digital Personal Data Protection Act, 2023.
  • Purpose of Data Use: The information and documents you provide will be utilized for the sole purpose of managing insurance-related needs and preferences.
  • Data Retention: Your personal data and documents will be retained by the Company to facilitate ongoing services and communications regarding your insurance preferences and requirements.

Force Majeure

SMC Insurance shall not be liable for any failure and/or delay on its part in performing any of its obligations under this Agreement and/or for any loss, damage, costs, charges, and expenses incurred and/or suffered by the User by reason thereof if such failure and/or delay shall be the result of or arising out of Force Majeure Event set out herein.

"Force Majeure Event" means any event due to any cause beyond the reasonable control of SMC Insurance, including, without limitation, unavailability of any communication system, sabotage, fire, flood, earthquake, explosion, acts of God, civil commotion, pandemic, strikes, lockout, and/or industrial action of any kind, breakdown of transportation facilities, riots, insurrection, hostilities whether war be declared or not, acts of government, governmental orders or restrictions, breakdown and/or hacking of the Platform and/or Contents provided and/or services under the Platform, such that it is impossible to perform the obligations under the Agreement, or any other cause or circumstances beyond the control of SMC Insurance hereto which prevents timely fulfillment of the obligation of SMC Insurance.

Payment Related Information

Access to Platform is free and Users (Registered or Guest) can browse the information/products and avail the Services free of charge. Please note that SMC Insurance is only assisting in the collection of premium amount on behalf of the insurer, whose insurance product you have chosen to buy. The acceptance of the insurance premium and final issuance of the policy is subject to underwriting norms and discretion of respective insurance company, whose policy you have chosen to buy.

Invoicing and Payment

The Vendor shall submit a valid tax invoice to SMC Insurance upon completion of the applicable Services, achievement of agreed milestones, or as otherwise specified in the Purchase Order. All invoices shall comply with the requirements of applicable tax laws and include such supporting documents or information as may reasonably be required by SMC Insurance.

Subject to verification and acceptance of the Services or Deliverables, SMC Insurance shall make payment of all undisputed invoice amounts within the payment terms specified in the applicable Purchase Order, calculated from the date of receipt of a valid and undisputed invoice.

If any invoice contains errors, omissions, discrepancies, or does not comply with the applicable contractual or statutory requirements, SMC Insurance may withhold payment of the disputed amount and notify the Vendor accordingly. The Vendor shall promptly issue a corrected or revised invoice, and the payment timeline for the disputed amount shall commence from the date of receipt of the corrected and undisputed invoice.

All payments shall be subject to applicable taxes, statutory deductions, withholding taxes, and other deductions required under applicable law.

Termination

SMC Insurance may terminate the Purchase Order, in whole or in part, by providing the Vendor with thirty (30) days' prior written notice, without assigning any reason.

Either Party may terminate the Purchase Order by providing written notice to the other Party if the other Party commits a material breach of its obligations and fails to remedy such breach within thirty (30) days, or such other reasonable period specified in the notice, after receiving written notice describing the breach.

SMC Insurance may terminate the Purchase Order with immediate effect by written notice if the Vendor:

  • becomes insolvent, enters into liquidation, bankruptcy, or any analogous proceeding;
  • ceases or threatens to cease its business operations;
  • commits fraud, misconduct, or any act that may adversely affect the reputation, business, or regulatory compliance of SMC Insurance; or
  • materially violates any applicable law, regulatory requirement, confidentiality obligation, data protection obligation, or information security requirement.

Upon termination or expiry of the Purchase Order, the Vendor shall:

  • immediately cease performing the terminated Services unless otherwise instructed by SMC Insurance;
  • provide all reasonable transition assistance requested by SMC Insurance to facilitate the orderly transfer of the Services to SMC Insurance or another service provider;
  • promptly return or securely destroy all Confidential Information, personal data, records, documents, systems access credentials, and other property belonging to SMC Insurance, except where retention is required by applicable law; and
  • submit any undisputed invoices for Services satisfactorily performed up to the effective date of termination.

Termination shall not affect any rights, obligations, liabilities, or remedies that have accrued prior to the effective date of termination. Any provisions which by their nature are intended to survive termination, including but not limited to confidentiality, intellectual property, data protection, indemnity, limitation of liability, audit, dispute resolution, and governing law, shall continue to remain in full force and effect.

Subcontracting

The Vendor shall not assign, delegate, transfer, or subcontract all or any material part of the Services under the Purchase Order without the prior written consent of SMC Insurance.

Where SMC Insurance approves the engagement of a subcontractor, the Vendor shall remain fully responsible and liable for the performance of the Services and for the acts, omissions, and compliance of its subcontractors. The Vendor shall ensure that every approved subcontractor is bound by written obligations that are no less stringent than those set out in the Purchase Order, including obligations relating to confidentiality, data protection, information security, regulatory compliance, intellectual property, and applicable laws.

The approval of any subcontractor by SMC Insurance shall not relieve the Vendor of any of its obligations or liabilities under the Purchase Order.

Anti-Bribery and Anti-Corruption

The Vendor shall comply with all applicable anti-bribery, anti-corruption, anti-fraud, and anti-money laundering laws, regulations, and industry standards in connection with the performance of the Services. The Vendor shall ensure that its employees, agents, representatives, affiliates, and approved subcontractors do not directly or indirectly offer, promise, give, solicit, or accept any bribe, improper payment, inducement, kickback, or any other undue advantage in connection with the Purchase Order.

The Vendor shall promptly notify SMC Insurance in writing of any actual, suspected, or alleged violation of this clause or any applicable anti-bribery or anti-corruption law. Any material breach of this clause shall constitute a material breach of the Purchase Order and may result in immediate termination by SMC Insurance, without prejudice to any other rights or remedies available under applicable law or the Purchase Order.

General

This Purchase Order, together with any documents expressly incorporated by reference, constitutes the entire agreement between SMC Insurance and the Vendor with respect to the subject matter hereof and supersedes all prior discussions, negotiations, representations, understandings, communications, or agreements, whether oral or written, relating to the same subject matter.

If any provision of this Purchase Order is held to be invalid, illegal, or unenforceable by a court or competent authority, the remaining provisions shall continue in full force and effect.

No failure or delay by either Party in exercising any right or remedy under this Purchase Order shall operate as a waiver of that right or remedy.

This Purchase Order shall be governed by and construed in accordance with the laws of India. Subject to any agreed dispute resolution mechanism, the courts at Delhi shall have exclusive jurisdiction over any disputes arising out of or in connection with this Purchase Order.
